  1. ADLER STORE ONLINE STORE TERMS AND CONDITIONS

    1. GENERAL PROVISIONS

    1.1. These ADLER STORE Online Store Terms and Conditions (hereinafter referred to as the "Terms") set out the conditions for placing and fulfilling orders for goods through the ADLER STORE online store

    1.2. The store sells goods to customers in Ukraine, Poland and other countries.

    1.3. Depending on the delivery country and the relevant market, the order is handled by one of the sellers.

    1.4. The information as to which seller is responsible for a particular sale is determined according to the delivery country and the information provided when placing the order.

    1.5. By placing an order, the customer confirms that they have read these Terms and agrees to them to the extent that they do not conflict with mandatory provisions of the law applicable to the relevant order.

    1.6. The seller has the right to amend these Terms. The new version becomes effective upon its publication on the website and applies to orders placed after it has entered into force.

    2. DEFINITIONS

    2.1. User means an individual who visits the website and uses its functionality.

    2.2. Customer means a user who has placed an order on the website for the purpose of purchasing goods.

    2.3. Seller means the relevant person specified in clause 1.3 of these Terms, depending on the delivery country and the seller handling the order.

    2.4. Goods means clothing, footwear, underwear, accessories and other goods offered for sale on the website.

    2.5. Order means a properly completed request by the customer to purchase goods through the website, including the information necessary for processing and delivery of the order.

    3. SUBJECT MATTER AND CONCLUSION OF THE CONTRACT

    3.1. The seller sells goods through the ADLER STORE online store.

    3.2. Before placing an order, the customer has the opportunity to review information about the goods, their main characteristics, price, available payment methods and delivery options.

    3.3. For orders in Ukraine, the terms of sale and information about the goods constitute a public offer within the meaning of Ukrainian law to the extent permitted by law.

    3.4. For orders in Poland and other EU countries, the contract is concluded in accordance with applicable consumer protection and distance contract legislation.

    3.5. An order is considered accepted by the seller after the customer receives confirmation of acceptance of the order or another electronic message clearly indicating that the seller has accepted the order, unless otherwise expressly provided by law.

    3.6. An automatic notification of receipt of an order does not by itself mean that the order has been accepted if it does not expressly state that the order has been accepted by the seller.

    3.7. If, after an order has been placed, it turns out that the ordered goods are unavailable, the seller will inform the customer and may offer another product, change the contents of the order or cancel the relevant part of the order with a refund of any amounts paid, if applicable.

    4. GOODS AND INFORMATION ABOUT THEM

    4.1. Product photographs on the website are illustrative. The shade, texture or minor visual characteristics of a product may differ depending on screen settings, lighting and other technical factors.

    4.2. Product descriptions contain the main information necessary to make a purchase. If the customer needs additional information about a product, they may contact the seller before placing the order.

    4.3. The customer is responsible for the accuracy of the information provided by them that is necessary for placing and delivering the order.

    4.4. If the customer provides incorrect or incomplete information that makes proper fulfilment of the order impossible, the seller has the right to contact the customer to clarify the information or cancel the order if its fulfilment is impossible.

    5. PRICE AND PAYMENT

    5.1. The product price is stated on the website in the currency applicable to the relevant market or country in which the order is placed.

    5.2. Prices for orders in Ukraine may be stated in Ukrainian hryvnia.

    5.3. Prices for orders in Poland may be stated in Polish zloty. For other countries, the currency and available payment methods are determined during checkout.

    5.4. Available payment methods are displayed during checkout and may depend on the delivery country.

    5.5. In Poland, available payment methods may include payment by bank card, BLIK, Apple Pay and Google Pay. The specific list of payment methods is determined at the time of placing the order.

    5.6. If an incorrect product price is displayed on the website due to an obvious technical or other error, the seller will inform the customer. The customer may confirm the purchase at the corrected price or cancel the order. If the customer cannot be contacted, the order may be cancelled and the amounts paid refunded.

    5.7. After an order has been confirmed, the product price for that order does not change, except in cases provided by law or agreed by the parties.

    6. PLACING AN ORDER

    6.1. The customer places an order through the website by providing the information necessary for its fulfilment and delivery.

    6.2. After placing an order, the customer may receive confirmation by email, SMS, messenger or another method, depending on the available communication channels.

    6.3. The seller may contact the customer to clarify order details, product availability, delivery method or other information necessary for fulfilment of the order.

    6.4. Providing a phone number and email address allows the seller to use them to contact the customer regarding the placing, payment, delivery, return and fulfilment of the order.

    6.5. Advertising messages are sent only within the limits permitted by law and based on the relevant consent of the customer where such consent is required.

    7. DELIVERY

    7.1. Available delivery methods, delivery countries and current delivery times are stated on the website in the relevant section and/or during checkout.

    7.2. Orders in Ukraine may be delivered, in particular, by Nova Poshta and other postal operators.

    7.3. International orders may be delivered by international postal and courier services, subject to the availability of a particular delivery method.

    7.4. Current information about delivery times and costs is stated on a separate page of the website and/or during checkout.

    7.5. Delivery times may depend on product availability, order processing time, the operation of postal or courier services, public holidays, customs procedures and other circumstances.

    7.6. Delivery delays caused by circumstances beyond the seller's reasonable control do not constitute a breach of the seller's obligations, unless otherwise provided by applicable law.

    7.7. If delivery is not included in the product price, the delivery cost is paid by the customer in the amount stated during checkout.

    7.8. For international shipments, the customer may be required to pay import duties, taxes, VAT, customs charges or other payments required by the law of the destination country if such payments are not included in the price or delivery cost.

    7.9. The seller cannot guarantee in advance the exact amount of such payments if they are determined by customs authorities or the law of the destination country.

    8. RETURNS AND RIGHT OF WITHDRAWAL

    8.1. The customer's rights regarding the return of goods are determined by the law applicable to the relevant order.

    8.2. For orders in Poland and other EU countries, if the customer has consumer status and unless otherwise provided by law, the customer has the right to withdraw from a distance contract within 14 days without giving a reason.

    8.3. The 14-day period for a contract for the sale of goods generally begins on the day the customer or a person designated by the customer receives the goods. In the case of an order consisting of several goods delivered separately, the period generally begins on the day the last item is received.

    8.4. To exercise the right of withdrawal, the customer must notify the relevant seller of their decision before the applicable period expires. The notification may be made in any unambiguous form that allows its content to be established.

    8.5. After withdrawing from the contract, the customer must return the goods without undue delay and, as a rule, no later than 14 days from the date of notifying the seller of the withdrawal.

    8.6. For orders in Poland and the EU, the customer generally bears the direct costs of returning the goods, unless the seller has agreed to bear them or the law provides otherwise.

    8.7. In the event of a valid withdrawal from the contract, the Polish seller refunds payments received from the customer in accordance with applicable law, including the cost of delivery to the customer up to the cost of the least expensive standard delivery method available.

    8.8. The seller may withhold the refund until the returned goods are received or until the customer provides proof of sending them back, whichever occurs earlier, if this is permitted by applicable law.

    8.10. For orders in Ukraine, the right to withdraw from a distance contract and the procedure for returning goods are governed by Ukrainian law. Unless otherwise provided by law, the consumer has the right to withdraw from a distance contract within 14 days in accordance with the procedure established by law.

    8.11. Returns to the Ukrainian seller are made to the address and by the method agreed with the seller after the customer has notified the seller of the return.

    8.12. Goods which, under applicable law, belong to categories for which the right of withdrawal or return may be restricted due to their nature may not be eligible for return after packaging or seals have been broken for reasons provided by law. In particular, this may apply to certain goods which, for hygiene reasons, cannot be returned after being unsealed.

    8.13. The customer has the right to try on or inspect the goods to the extent necessary to check their properties and characteristics. If the customer goes beyond what is necessary for such inspection, they may be liable for a reduction in the value of the goods in accordance with applicable law.

    9. COMPLAINTS AND NON-CONFORMITY OF GOODS

    9.1. The customer has the right to submit claims to the seller regarding defects or non-conformity of goods in accordance with the law applicable to the relevant order.

    9.2. For orders in Poland and other EU countries, consumers may exercise their rights in connection with non-conformity of the goods with the contract in accordance with Polish consumer protection law.

    9.3. Under Polish law, the seller's liability for non-conformity of the goods with the contract generally lasts for 2 years from the date the goods are delivered, unless a different period is provided by law.

    9.4. In the event of non-conformity of the goods with the contract, a Polish consumer may request, in particular, that the goods be brought into conformity by repair or replacement and, in cases provided by law, a reduction in price or withdrawal from the contract.

    9.5. A complaint may be submitted in a form that allows the customer to notify the seller of the non-conformity of the goods and the requested remedy.

    9.6. For orders in Ukraine, complaints are handled in accordance with Ukrainian consumer protection law.

    9.7. Requests concerning returns or complaints should preferably include the order number, a description of the issue and, where possible, photographs of the goods.

    9.8. The absence of a fiscal receipt does not in itself deprive a consumer of their rights if the fact of purchase can be confirmed by another appropriate means, in cases provided by applicable law.

    10. PERSONAL DATA

    10.1. The customer's personal data is processed for the purposes of placing, paying for, fulfilling and delivering orders, communicating with the customer, processing returns and complaints, and fulfilling other obligations of the seller.

    10.2. Personal data is processed in accordance with the law applicable to the relevant seller and order.

    10.3. For the purpose of fulfilling an order, the customer's data may be transferred to payment operators, postal and courier services, electronic communication service providers and other service providers involved in fulfilment, to the extent necessary for the order and other lawful purposes.

    10.4. Advertising and marketing messages are sent in accordance with applicable law and where there is an appropriate legal basis or consent.

    11. LIABILITY

    11.1. The seller and the customer are liable in accordance with the law applicable to the relevant order.

    11.2. No provision of these Terms limits consumer rights that cannot be waived under mandatory provisions of applicable law.

    11.3. The seller is not liable for delays or inability to fulfil obligations caused by third parties, postal operators, payment systems, customs authorities or other circumstances beyond the seller's reasonable control, to the extent permitted by law.

    12. FINAL PROVISIONS

    12.1. The relationship between the seller and the customer is governed by the law applicable to the relevant order.

    12.2. For orders handled by the Polish seller, mandatory consumer rights provided by Polish and European Union law remain applicable regardless of the provisions of these Terms.

    12.3. For orders handled by the Ukrainian seller, mandatory provisions of Ukrainian consumer protection law and other legislation governing the relevant legal relationship apply.

    12.4. If any provision of these Terms is found to be invalid or unenforceable, this does not affect the validity of the remaining provisions.

    12.5. These Terms are published electronically on the ADLER STORE website and may be saved by the customer in an unchanged form.
